
THE RIGHT TO REFUSE A POLYGRAPGH
You have the absolute right to refuse a polygraph examination. Consider this: polygraph examination results are not admissible in military courts-martial because they are not scientifically reliable. Why then do military law enforcement organizations such as CID, OSI and NCIS continue to perform polygraph examinations of servicemembers? It is our experience that law enforcement organizations use polygragh examinations as interrogation tools to coerce servicemembers into confessing their alleged crimes.
IMPORTANT NOTE #1: If someone has asked you to take a polygraph examination, you are suspected of a crime! A polygraph examiner is not a doctor, a scientist or a technician. He or she is a federal law enforcement agent whose sole purpose is to build a case againt you.
IMPORTANT NOTE #2: It is legal for law enforcement officials to lie to you during an interrogation. Law enforcement officials regularly lie to persons who have consented to a polygraph examination. After the lie detector test/polygraph examination, a polygraph examiner will likely allege that you have failed the test (whether you have actually failed or not) and will follow up with the question, "Since we know you are lying, why don't you tell us what really happened."
CONCLUSION: You cannot trick a polygrapgh examiner. If you consent to a polygraph examination, the only one getting tricked is YOU.
